Summary

• MyPlanBuddy is a personal organization app. It is not a health service, it does not diagnose anything, and it does not replace professionals.
• The app's suggestions are only suggestions: you decide what to do.
• There is no sign-up. Your data stays on your device and in your iCloud, and we don't have a copy of it.
• The app has free features and an optional subscription, Buddy+, billed and managed by Apple.
• Nothing in these Terms reduces your consumer rights.

1. Who we are and acceptance

MyPlanBuddy is developed and made available by GABRIEL RIGON TECNOLOGIA LTDA (GBRLRG) ("we" or "us").

These Terms govern the use of MyPlanBuddy on iPhone, iPad and Apple Watch. By using the app, you agree to them and to the Privacy Policy, which explains how data is processed. If you don't agree, don't use the app.

2. What MyPlanBuddy is

MyPlanBuddy helps you organize tasks and routines, fitting them into the time windows of your day, with guilt-free replanning. It adapts its suggestions to your context: what you tell it in the check-in (if you allow it) and your usage history. Data from the Health app, if you allow it, is used only to show an estimated energy and never decides the suggestions.

To decide when and how to make suggestions, the app draws on the Just-in-Time Adaptive Interventions (JITAI) approach described in the scientific literature (Nahum-Shani et al., Annals of Behavioral Medicine, 2018, DOI 10.1007/s12160-016-9830-8). This is only a design reference: it does not mean that MyPlanBuddy is certified, approved or endorsed by the authors or by institutions connected to them.

3. MyPlanBuddy is not a health service

MyPlanBuddy is an organization and well-being tool. It is not a medical device and is not intended to prevent, diagnose, treat or monitor diseases or health conditions, whether physical or mental.

The estimated energy, the mood of the day, the charts on the Rhythm screen and the app's messages show trends relative to your own usual, calculated from the available data. They may be wrong or incomplete and are not clinical measurements. The app does not replace assessment or follow-up by a health professional.

If you are in crisis or in an emergency, don't rely on the app. Call 188 (CVV, Brazil's emotional support line, 24 hours, free of charge) or 192 (SAMU, Brazil's emergency medical service), or go to the nearest health service.

4. Adaptive suggestions

The app may suggest, for example, starting with a lighter task, pushing another one back, getting ahead on tasks on a good day, shortening the list on a heavy day, sending fewer reminders or proposing times with "find a time". The general criteria are in section 5 of the Privacy Policy.

Suggestions are assistive and not mandatory. No proposed time becomes a task, and no task is changed, without your confirmation. You remain responsible for your decisions, commitments and deadlines, and you can accept, ignore or change any suggestion.

5. Health app data and check-ins

Using the Health app is optional, read-only and depends on your permission in the system. Answering the daily check-in is also optional. The app works without either of them. The details are in the Privacy Policy.

You control the permissions in the system Settings and in the Health app and can revoke them at any time. Without them, some features appear in a reduced form or don't appear.

6. Your data stays with you

MyPlanBuddy has no sign-up and no servers of its own. Your information stays on your device and, to sync across iPhone, iPad and Apple Watch, in your iCloud, in your Apple Account.

Therefore:

• syncing and backups depend on iCloud and on your device settings, which are Apple services;
• we don't have a copy of your data and cannot recover it if it is deleted, if the device is lost or if iCloud is turned off;
• we recommend keeping iCloud turned on for MyPlanBuddy and backing up your device.

The content you create in the app, such as tasks, notes and routines, is yours. We don't receive this content and don't use it for any purpose.

7. Free features and Buddy+

MyPlanBuddy has free features and an optional subscription, Buddy+, which unlocks additional features. The features, plans, prices and conditions of each offer appear on the subscription screen before purchase.

• Billing by Apple: the subscription is purchased, billed and managed by Apple, in your Apple Account, and follows the App Store terms. We don't receive your payment details.
• Automatic renewal: the subscription renews at the end of each period, for the same length of time, unless you cancel at least 24 hours before the end of the current period.
• Free trial: when offered, billing starts at the end of the trial if you don't cancel before then. With notifications turned on, the app lets you know before the trial ends.
• Cancellation: in Settings > [your name] > Subscriptions, on the device. Cancellation takes effect at the end of the period already paid, and Buddy+ features remain available until then.
• Refunds: requested from Apple, at reportaproblem.apple.com, according to Apple's rules, without prejudice to the rights guaranteed by the Consumer Defense Code (Código de Defesa do Consumidor).
• Price changes: if the price changes, Apple notifies you and, when its rules require, asks for your agreement before renewal.
• Restore purchase: if you switch devices, use "restore purchase" in the app.
• Free plan limits: some features have a limit on the free plan, such as the number of "find a time" requests per month, shown in the app itself. With Buddy+, this feature has no monthly limit.

8. System features

Some features depend on Apple technologies and only work on compatible devices and system versions:

• Artificial intelligence: understanding "find a time" requests, organizing and categorizing tasks, turning text into tasks, and writing the weekly summary, the sentences about what's stuck and the week's energy summary use Apple's on-device model. The AI only interprets requests and writes text: times are calculated by the app's rules. Generated text and proposed times may contain errors; review them before confirming. On devices without this feature, the app uses simpler rules.
• Siri and Shortcuts: asking for "Find a time" through Siri or the Shortcuts app opens the app; Siri is subject to Apple's terms.
• Voice: creating tasks by voice uses the microphone and Apple's speech recognition.
• Notifications, widgets, complications and Live Activities: may show task names and the day's energy, including on the Lock Screen. Adjust this in the system Settings if you prefer more discretion.
• Apple Watch: the watch app depends on the iPhone app.

9. License to use and relationship with Apple

We grant you a personal, non-exclusive, non-transferable and revocable license to use MyPlanBuddy on the Apple devices you own or control, for personal and non-commercial purposes.

The license for the app downloaded from the App Store is also governed by Apple's standard Licensed Application End User License Agreement. These Terms supplement that agreement. In case of conflict, the interpretation most favorable to you prevails, within the limits of the law.

These Terms are entered into between you and us, not with Apple. Apple is not responsible for the app or for supporting it. Use of Apple services (iCloud, App Store, Health, Apple Watch, Apple Intelligence, Siri) is also subject to Apple's own terms and policies.

10. Permitted use

Use MyPlanBuddy lawfully and in accordance with these Terms. You may not:

• copy, modify, distribute, sell or rent the app;
• reverse engineer, decompile or attempt to extract the source code, except where permitted by law;
• circumvent security mechanisms, subscription mechanisms or technical restrictions;
• use the app to harm third parties or for unlawful activities.

11. Intellectual property

MyPlanBuddy, including its name, brand, mascot, design, illustrations, text, code and the way the suggestion rules were organized, belongs to GBRLRG or is used with permission, and is protected by Brazilian Laws No. 9,610/1998 (copyright), No. 9,609/1998 (software) and No. 9,279/1996 (industrial property). These Terms do not transfer to you any ownership rights over the app.

12. Availability and updates

We work to make the app run well, but we don't guarantee uninterrupted or error-free operation. The app may be affected by system failures, unavailability of Apple services (such as iCloud), version incompatibilities, device problems or events beyond our control.

The app may receive updates to fix errors, improve security, change or add features and adapt to changes by Apple or in the law. Older system versions may stop being supported.

13. Liability

We are liable for MyPlanBuddy under the law, including the Consumer Defense Code. Nothing in these Terms excludes or limits rights that the law guarantees you.

Within those limits, we are not responsible for:

• personal, professional or routine decisions you make based on the app's suggestions, estimates or text;
• interpreting the estimates as if they were a medical or psychological assessment;
• failures, losses or unavailability caused by Apple services, by your device or by your settings, such as iCloud being turned off or not having a backup.

14. Termination

You can stop using MyPlanBuddy whenever you want: just uninstall the app and, if you wish, delete the data in iCloud (see section 10 of the Privacy Policy). Active subscriptions must be canceled in your Apple Account, because uninstalling the app does not cancel billing.

We may discontinue the app or suspend features when required by law, for technical reasons or in case of a violation of these Terms. Whenever possible, we will give advance notice. If Buddy+ is discontinued during a period already paid, you keep your consumer rights, including the right to be reimbursed for the unused period.

15. Changes to these Terms

We may update these Terms when the app changes or when the law requires. The date of the last update is always at the top. Material changes will be announced in the app before they take effect. If you don't agree with the new version, you can stop using the app and cancel the subscription.

16. Governing law and jurisdiction

These Terms are governed by Brazilian law. Any disputes may be brought before the courts of your place of residence, as guaranteed by the Consumer Defense Code. Before that, talk to us: most problems are resolved by email.

If any clause is held invalid, the remaining clauses remain in effect.
